Welcome to NIVOR. Throughout the site, the terms “we”, “us” and “our” refer to NIVOR.

We operate this website and online store, including all related information, content, products and services (the “Services”), to provide you with a curated shopping experience. Our store is hosted on Shopify, which enables us to offer our Services.

Some products offered through our store are fulfilled directly by NIVOR, while others are produced and shipped by trusted third-party fulfillment partners.

By accessing or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use our Services.

SECTION 1 – ELIGIBILITY & USE

By using our Services, you confirm that:

  • you are at least 18 years old (or the age of majority in your country)

  • all information you provide is accurate and complete

You are responsible for maintaining the confidentiality of your account and all activities under it.

SECTION 2 – PRODUCTS

We strive to display our products as accurately as possible. However:

  • colors and appearance may vary depending on your device

  • slight variations in print placement, fabric, stitching, or finish may occur

  • product mockups are for illustrative purposes only

All product descriptions, pricing, and availability are subject to change without notice.

SECTION 3 – ORDERS & CONTRACT FORMATION

By placing an order, you make a binding offer to purchase.

A contract is only concluded once you receive an order confirmation from NIVOR.

We reserve the right to:

  • refuse or cancel orders at our discretion

  • limit quantities per customer

  • refuse orders suspected of fraud or abuse

SECTION 4 – PRICES & TAXATION

All prices are stated in EUR (€).

Important Notice (Kleinunternehmerregelung)

In accordance with §6 Abs. 1 Z 27 UStG (Austria), no VAT is charged or shown.

Shipping costs and possible import duties or customs fees are not included unless explicitly stated.

Customers outside the European Union may be responsible for additional customs charges, taxes, or import fees imposed by their country.

SECTION 5 – PAYMENT

You agree to provide accurate payment details.

By placing an order, you confirm that:

  • you are authorized to use the selected payment method

  • all charges will be honored

Orders may be canceled if payment authorization fails.

SECTION 6 – SHIPPING & DELIVERY

Orders may be fulfilled either directly by NIVOR or by third-party fulfillment partners.

As a result:

  • products may arrive in separate packages

  • delivery times may vary depending on product type and destination

  • some items may be produced internationally before shipment

Estimated delivery times are provided for guidance only and are not guaranteed.

We are not responsible for delays caused by:

  • shipping carriers

  • customs processing

  • force majeure events

  • incorrect shipping information provided by the customer

Risk of accidental loss or damage transfers to the customer upon delivery of the goods.

SECTION 7 – RETURNS & REFUNDS

Returns and refunds are governed by our Return & Refund Policy.

SECTION 8 – INTELLECTUAL PROPERTY

All content on this website, including branding, graphics, product designs, text, logos, and images, is the property of NIVOR and protected by intellectual property laws.

You may not reproduce, distribute, modify, or commercially use any content without prior written permission.

SECTION 9 – THIRD-PARTY SERVICES

We may provide access to third-party tools, platforms, or services.

We are not responsible for:

  • third-party content

  • functionality

  • interruptions

  • damages arising from their use

This includes services provided by Shopify, payment providers, shipping carriers, and fulfillment partners.

SECTION 10 – SHOPIFY RELATIONSHIP

Our store is powered by Shopify.

All purchases are made directly with NIVOR. Shopify is not responsible for any transactions, products, fulfillment obligations, or disputes.

SECTION 11 – LIABILITY

To the fullest extent permitted by law:

  • we are not liable for indirect or consequential damages

  • our liability is limited to the amount paid for the purchased product

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

SECTION 12 – RIGHT OF WITHDRAWAL (EU)

Consumers within the European Union have the legal right to withdraw from eligible purchases within 14 days.

SECTION 13 – PROHIBITED USE

You may not use our Services:

  • for unlawful purposes

  • to violate intellectual property rights

  • to distribute malicious software or harmful content

  • to interfere with the security or operation of the Services

We reserve the right to suspend or terminate access if these Terms are violated.

SECTION 14 – TERMINATION

These Terms are governed by the laws of Austria.
